Introduction and acceptance of terms

Welcome to Nano Banana, an AI-powered image and video generation and editing platform. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use the service.

Use of the service

The service offers text to image, image editing, text to video, first/last frame to video and reference images to video. Models come from third-party providers through the Yir model gateway. Nano Banana is an independently operated website and is not affiliated with Google or any other model provider; model names and trademarks belong to their owners. We may change, add or retire models and features, and a model may be temporarily unavailable for reasons on the provider's side.

You agree to use the service in accordance with all applicable local, state, national and international laws and regulations.

Commercial use restrictions

Works generated with free credits (including the welcome credits given at sign-up), a Starter subscription or credit packs are strictly prohibited from commercial use or any profit-making activity. Commercial use includes but is not limited to:

• Selling generated works or products containing them;
• Using generated works in advertising or marketing materials for commercial purposes;
• Incorporating generated works into products or services offered for sale;
• Any other activity intended to generate revenue or profit.

A commercial license is granted automatically with a Pro or Premium subscription, allowing commercial use of works generated while the subscription is active. The license ends when the subscription ends or is refunded. Some model providers have their own terms for generated content; check them as well before commercial use.

We reserve the right to pursue all available remedies for violations of these restrictions, including but not limited to account termination and recovery of damages.

User accounts and registration

1. Account creation: Some features require an account. You must provide accurate and complete information when you register.
2. Account security: You are responsible for keeping your credentials confidential and for all activity under your account.
3. User responsibilities: Notify us immediately of any unauthorized use of your account or other security breach.
4. Age: You must be at least 13 years old, or older where local law requires.

Credits

• Credits are the site's usage allowance and pay for generations. Credits are not money, cannot be exchanged for cash and cannot be transferred to another account.
• Each generation shows its credit cost before you submit. Every image or video is charged separately: successful outputs are charged, and the credits for failed outputs are refunded automatically.
• New accounts get a one-time credit grant. Only the first 2 accounts from one IP receive it, and we may take back credits obtained through bulk sign-ups or similar abuse.
• Subscriptions grant credits once per billing period, and subscription credits do not expire. Credit pack credits are valid for 12 months from purchase and then expire.
• Credits that expire soonest are spent first.

Content and intellectual property rights

All content provided through the service, including but not limited to the website, software, technology and documentation, is protected by copyright law. The copyright owner of Nano Banana is Nano Banana.

• You acknowledge that you do not own the underlying technology or intellectual property of the service, and you agree to respect the intellectual property rights of Nano Banana and any third parties.
• You keep ownership of the original images you upload. Subject to these terms (including the commercial use restrictions above) and the model providers' terms, you may use the works you generate.
• You grant us a limited license to store and process your uploaded content and send it to the model service, solely to provide the service to you.
• Administrators may feature some works on the public showcase page (without your email or name). Contact us if you want a work taken down.
• Data usage commitment: We do not use your uploaded images or generated works to train AI models of our own.

Prohibited activities

You agree not to:

• Access without authorization, reverse engineer or copy the site's systems and technology;
• Interfere with or disrupt the security or performance of the service;
• Generate illegal, harmful or offensive content;
• Generate, edit, request or distribute pornographic, sexually explicit or other adult sexual content, including any content involving minors;
• Generate abusive, fraudulent or misleading content depicting a real person without their consent, including deepfakes;
• Bypass any security feature, usage limit or access control, including bulk sign-ups to collect credits;
• Upload copyrighted material without proper authorization;
• Use the service commercially in ways that violate copyright or other intellectual property laws.

Model providers may also refuse some requests; a refused generation counts as failed and its credits are refunded. We may remove content that breaks these rules and suspend or close the accounts involved.

Privacy and data collection

We collect account information, usage data, device information, the prompts and reference images you provide, cookies, and the transaction information needed to process payments. See our Privacy Policy for details.

Pricing and payments

• We take payment through Stripe only. Prices are in US dollars as shown at checkout.
• Purchases may be refunded within 7 days under specific conditions: fewer than 10 generation tasks submitted since the purchase and at least 80% of its credits unused. See our Refund Policy.
• Prices may change with notice to users.
• You agree to pay all charges for the plan you select.
• Subscriptions renew automatically each billing period (monthly or yearly) until you cancel. You can cancel from the billing page in your account, which opens Stripe's billing portal, or by emailing support@nanobanana0.com.

Termination

We may terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these terms or harms other users, us or third parties. Remaining credits on an account closed for abuse are not refunded. You may also contact us to close your account at any time.

Disclaimer of warranties

The service is provided on an "as is" and "as available" basis. We make no warranties about its accuracy, reliability or availability and disclaim all warranties to the fullest extent permitted by law. AI output can be inaccurate or unexpected; you decide whether it is fit for your use.

Limitation of liability

To the fullest extent permitted by law, Nano Banana shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from the use of or inability to use the service.

Indemnification

You agree to indemnify and hold harmless Nano Banana, its affiliates, and their officers, directors, employees and agents from any claims, damages, losses, liabilities and expenses (including attorneys' fees) arising from your use of the service or violation of these terms.

Governing law and dispute resolution

These terms are governed by and construed in accordance with the laws of the jurisdiction in which Nano Banana operates, without regard to its conflict of law provisions. Any dispute arising from these terms or the service will be resolved through binding arbitration in accordance with applicable law.

Changes to these terms

We may update or modify these terms at any time. Changes take effect as soon as they are posted on the site. Continuing to use the service after a change means you accept the updated terms.
